Fresno, CA, September 14 – A pedestrian died Friday morning after being struck by a vehicle while trying to cross Highway 99, according to the California Highway Patrol. The man was walking across the freeway’s southbound lanes when a pickup truck hit him, and he was pronounced dead at the scene. His name and age have not been released. The California Highway Patrol is investigating the crash and has asked anyone with information to come forward.

The California Highway Patrol said the crash was reported at around 5:50 a.m. on September 11, on Highway 99 south of Ventura Street. The pedestrian was attempting to cross the highway’s southbound lanes at the time and was struck by a 2017 Chevrolet Silverado traveling in the No. 1 lane.
The driver of the Silverado remained at the scene after the crash and contacted authorities, according to the California Highway Patrol. The CHP said the investigation was ongoing as of Friday and asked anyone who witnessed the crash, or who has information about it, to call the department at 559-662-0400.
According to the CHP, the identity of the pedestrian has not been released and his age was not immediately known. It also remains unclear whether impairment played any role in the crash. No further details about the collision had been released as of Friday morning, and additional information may follow as the investigation continues.

Code of Civil Procedure section 335.1 gives two years for an action for injury to, or for the death of, an individual caused by the wrongful act or neglect of another. The same two years covers an injury claim and a death claim; there is no separate, shorter period because someone died.
Who is entitled to bring a claim when someone is killed
Code of Civil Procedure section 377.60 decides who may bring a wrongful death action. The first group is the surviving spouse, domestic partner, children and the issue of deceased children, or, where there is no surviving issue, whoever would take the estate by intestate succession.
A second group may bring the action only if they were financially dependent on the person who died: a putative spouse and their children, stepchildren, parents, and the legal guardians of the person who died where the parents are deceased. Parents are in that second group, which is the part families are most often surprised by, because dependency has to be shown rather than assumed.
