Ventura, CA, October 17 – A pedestrian died in a collision on southbound U.S. Highway 101 in Ventura on Saturday night, according to the California Highway Patrol. The man was found in the roadway and was pronounced dead at the scene. A vehicle linked to the incident was found stopped nearby, and the CHP said the collision remains under investigation. Further details about how the crash happened have not yet been released.

The California Highway Patrol said the collision occurred at about 8:56 p.m. Saturday on southbound U.S. 101, just south of the West Main Street off-ramp. Officers responding to the area found a man in the roadway. A black BMW was also stopped nearby on the right shoulder with its hazard lights activated, according to initial reports reviewed by the CHP.

At approximately 9:15 p.m., about nineteen minutes after the collision occurred, a woman called authorities to say that her daughter, who had been driving a blue 2016 BMW 328i, believed she might have struck something on the freeway but was unsure what it was, according to the CHP. The driver subsequently pulled over on the right shoulder near California Street.

Ventura County Fire Department personnel responded to the scene after the collision was reported, and the Ventura County coroner’s office was notified at approximately 9:28 p.m., according to the CHP. The pedestrian was pronounced dead at the scene. His identity has not been released, and no further information about him has been made public.

The investigation remains open, according to the California Highway Patrol. The agency said no citations or arrests have been announced, and it has not released information about what caused the collision, how fast the vehicles involved were traveling, or whether impairment played any role. The exact connection between the man found in the roadway and the vehicles described by investigators has also not been confirmed, and no further details have been provided.

The deadline that applies to a claim like this one

Code of Civil Procedure section 335.1 gives two years for an action for injury to, or for the death of, an individual caused by the wrongful act or neglect of another. The same two years covers an injury claim and a death claim; there is no separate, shorter period because someone died.

Who is entitled to bring a claim when someone is killed

Code of Civil Procedure section 377.60 decides who may bring a wrongful death action. The first group is the surviving spouse, domestic partner, children and the issue of deceased children, or, where there is no surviving issue, whoever would take the estate by intestate succession.

A second group may bring the action only if they were financially dependent on the person who died: a putative spouse and their children, stepchildren, parents, and the legal guardians of the person who died where the parents are deceased. Parents are in that second group, which is the part families are most often surprised by, because dependency has to be shown rather than assumed.

Talking to someone about it

Culver Legal represents people injured in collisions across California. A conversation about what happened costs nothing, and we work on a contingency fee, which means there is no fee unless we win. If we do not win, we do not pass the case costs on to you either.

Nothing on this page is legal advice about any particular case, and the facts of a reported collision often change as the investigation continues.
