Whitewater, CA, October 8 – A semi-truck and a vehicle believed to be a Honda Civic collided on eastbound Interstate 10 west of State Route 111 at about 9:18 p.m. Wednesday, leaving two people with moderate injuries, according to the California Highway Patrol. The impact scattered debris across the lanes and left the big rig overturned in a ditch beside the freeway, prompting an emergency response from fire crews.

The California Highway Patrol said firefighters were called out after the crash, and the vehicles were later shifted to the right shoulder of the freeway. The agency also said the No. 5 lane stayed closed as crews worked to clear the area, and heavy-duty tow trucks were brought in to right the overturned semi-truck and haul it away.

Investigators have not yet determined what caused the semi-truck and the other vehicle to collide on that stretch of eastbound I-10, the California Highway Patrol said. The agency has not released any additional details about how the two vehicles came together or confirmed a specific cause for the crash so far.

Also not yet known is whether either driver was cited or arrested in connection with the crash, or how badly the two injured parties were hurt beyond the moderate injuries described by the California Highway Patrol. The agency has not released the ages of those involved or confirmed the type of vehicle that collided with the semi-truck beyond describing it as a possible Honda Civic.

Why evidence in a commercial vehicle case has a deadline of its own

A collision involving a commercial vehicle is not simply a larger car accident. The carrier holds records the other driver never has: electronic logging data, maintenance and inspection history, dispatch instructions and driver qualification files.

Those records are the best evidence of what happened and they do not last indefinitely. Retention periods are measured in months for some categories, so the window to preserve them can close long before the deadline to file a lawsuit does. A preservation demand sent early is the step that keeps them available.

The deadline that applies to a claim like this one

Code of Civil Procedure section 335.1 gives two years for an action for injury to, or for the death of, an individual caused by the wrongful act or neglect of another. The same two years covers an injury claim and a death claim; there is no separate, shorter period because someone died.

Talking to someone about it

Culver Legal represents people injured in collisions across California. A conversation about what happened costs nothing, and we work on a contingency fee, which means there is no fee unless we win. If we do not win, we do not pass the case costs on to you either.

Nothing on this page is legal advice about any particular case, and the facts of a reported collision often change as the investigation continues.
