The left turn across your path is the classic case. A driver turns left in front of an oncoming motorcycle, then says they never saw it. That is a failure to yield, and the fact that a motorcycle is narrower and harder to judge is the driver’s problem to account for, not yours.
Helmets are required in California, for every rider and passenger, and that is a genuine difference from bicycles. Not wearing one does not bar a claim, but it gives the other side a comparative fault argument on head injuries specifically.
Being partly at fault does not end your claim. California uses pure comparative fault, so your share reduces a recovery rather than barring it.
Bias is the real adversary here, and it is worth naming. Motorcycle claims are defended harder than car claims on identical facts, because the defense relies on a juror’s assumption that riders take risks. How Long Do You Have to File a Gardena Motorcycle Accident Claim?
Two years from the date of the crash to file suit, under Code of Civil Procedure section 335.1.
Six months if a government entity is involved, under Government Code section 911.2. On a motorcycle claim this is not remote: a crash caused by a pothole, a bad repaving seam or a missing sign is a claim against whoever maintains the road.
And six months is less time than it sounds. A claim against the City of Gardena is filed with the City Clerk at City Hall, and the City Attorney’s office then reviews it and issues a written recommendation to approve or deny. What Should You Do After a Motorcycle Accident in Gardena?
