Who Can File a Wrongful Death Claim in Orange County

Under California Code of Civil Procedure Section 377.60, eligible claimants include the surviving spouse or registered domestic partner, children of the deceased, and parents if there is no surviving spouse or children. Siblings may file in limited circumstances when no other eligible survivors exist. Domestic partners must demonstrate financial dependence or cohabitation to establish eligibility.

California law also permits a survival action filed on behalf of the deceased’s estate alongside the wrongful death claim. Our wrongful death attorneys evaluate both tracks in every case. A wrongful death claim compensates survivors for their own losses. A survival action recovers what the deceased could have claimed had they survived, including pain and suffering before death. Both can often be pursued together.

How Long Do You Have to File in Orange County

Under California Code of Civil Procedure Section 335.1, you have two years from the date of your loved one’s death to file a wrongful death lawsuit. That deadline is hard. Missing it almost always ends the case permanently.

There is a shorter window that catches many families off guard. If a government entity is responsible, including a city vehicle, the Orange County Transportation Authority, CalTrans, or any public agency, you must file an administrative claim within six months of the date of death. Miss that window and your claim may be permanently barred, regardless of how strong the underlying case is. If there is any possibility that a public entity is involved, call us immediately.

What Compensation Is Available

Recoverable damages in an Orange County wrongful death case can include loss of financial support the deceased would have provided over their lifetime, the value of household services and childcare contributions, funeral and burial expenses, and non-economic losses, including companionship, guidance, and consortium for surviving spouses. In a survival action, the estate may also recover pain and suffering the deceased experienced before death.

Insurance companies move quickly after a fatal accident. Early settlement offers rarely reflect the full lifetime value of the loss. We retain forensic economists and expert witnesses to calculate projected contributions over a complete lifetime before negotiating. We do not accept the first number.

California is a pure comparative fault state. Even if your loved one bore some responsibility for the incident, the family can still recover. If a case is valued at $1,000,000 and the deceased is found 25% at fault, the family still recovers $750,000.A partial fault does not eliminate the claim.

Wrongful Death in Orange County: What Makes These Cases Complex

Wrongful death cases involve simultaneous legal tracks, competing interests among family members, and medical causation disputes that insurers exploit at every stage. The dual-claim structure requires precise analysis of which damages belong to which claim and how proceeds should be divided among eligible survivors. Blended families and estranged relatives can create distribution disputes that must be resolved before or during settlement.

Defense teams retain medical experts specifically to argue pre-existing conditions caused the death rather than the defendant’s conduct. Securing your own expert witnesses early gives your case the structural advantage it needs. Once the other side has locked in its experts, it becomes harder and more expensive to counter them.

Cases involving government entities present additional complexity. The six-month administrative claim deadline, sovereign immunity rules, and specific procedures for naming a public agency as a defendant differ fundamentally from standard civil litigation. Orange County wrongful death filings are handled at the Central Justice Center in Santa Ana, which operates under local court rules and judicial assignment protocols our attorneys know well.

Immigration status does not affect your right to file. California law prohibits using a claimant’s documentation status in a personal injury or wrongful death case. Every eligible surviving family member has the right to pursue compensation regardless of their status.

Nothing upfront. Culver Legal works on contingency, so the fee comes out of a recovery rather than out of your pocket, and there is no fee unless we win. The consultation is free. Case costs are advanced by the firm. The exact percentage is set out in writing in the agreement before you sign anything.

No. Most of a case is handled by phone, and where meeting in person helps, we come to you. That includes your home and the hospital, and it is not limited to those. Tell us where works and we will be there. Not being able to travel does not hold your claim up.

No. A recorded statement makes some things harder, but it does not end a claim. What matters is what you said about fault and about your injuries, and whether you have since been treated. Tell us what you remember saying and we will tell you plainly where it leaves you.

No. California law lets you bring a personal injury claim and recover damages regardless of immigration status, and it is not a question we ask.

Yes. Our team speaks Spanish, Farsi, Filipino, Hindi, Mandarin and Korean. A claim should not turn on whether you can explain what happened in English.

Most personal injury cases settle, because both sides would rather have a certain number than a verdict. A case goes further when the offer on the table does not reflect what actually happened to you. Either way, Culver Legal handles cases in house rather than passing them to another firm, so the people who evaluate your case are the people who would take it forward.

Longer than most people expect, and the reason is medical rather than legal. A claim cannot be valued properly until your treatment stabilizes, because future care is usually the largest single number in it, and that number cannot be totaled while you are still being treated. Settling before that point is the most common way people are underpaid. Once the medical picture is clear, the negotiation itself is usually the shorter half.
