California raised its minimum liability limits, but only for policies issued or renewed on or after January 1, 2025. Before that date the floor was $15,000 for one injured person and $30,000 for everyone in the crash. From that date it is $30,000 and $60,000, with property damage cover rising from $5,000 to $15,000. Both figures are live at once, because the statute keys the increase to the policy rather than to the crash. How Much Insurance Is Actually Available?

Two things follow that are worth acting on.

A minimum policy still runs out fast. An emergency room visit, imaging and a short admission can exceed $30,000 on their own. When it does, the argument stops being about fault and becomes about where else the money is.

So the real work is finding every policy that might respond, and there are usually more than people expect: the at-fault driver’s own cover, a separate policy held by whoever owned the vehicle, a commercial policy if the driver was working at the time, and your own uninsured and underinsured motorist cover, which responds when the other side’s limits do not stretch. That last one is on your policy, it is often forgotten, and using it is not a claim against you.

What the Bakersfield Crash Data Actually Shows

The California Office of Traffic Safety publishes crash rankings for every city, drawn from statewide collision data. Bakersfield is measured against the 15 California cities with populations over 250,000, and in these tables a rank of 1 is the worst.

In 2023 there were 2,073 people killed or injured in crashes in Bakersfield, ranking the city 8th of those 15. On that headline number Bakersfield sits in the middle of its group, and any page telling you it is the most dangerous city in California has not looked.

Alcohol is the exception, and it is stark. 340 people were killed or injured in crashes involving alcohol in 2023, ranking Bakersfield 3rd of 15. In the narrower category of drivers under 21 who had been drinking, 36 victims put the city 1st of 15, which in these rankings means worst in the group. That was also true in 2020.

Why this matters to a claim rather than to a headline: where a driver had been drinking, there may be a claim beyond the driver, and punitive damages become a live question rather than a theoretical one.

The other category worth naming is hit and run. 238 people were killed or injured in hit-and-run crashes in Bakersfield in 2023, ranking the city 8th of the 15. If that happened to you, two things are true and both are more encouraging than people assume. An uninsured motorist claim on your own policy can respond even where the driver is never identified. And the police department runs a dedicated Hit and Run Detail whose officers follow up on every hit-and-run collision in the city and review every hit-and-run report the traffic and motorcycle officers write. What If the Insurer Says I Was Partly at Fault?

California reduces your recovery by your share of the blame rather than barring it. If a claim is worth $400,000 and you are found 25 percent responsible, you recover $300,000.

That rule is why adjusters push fault onto injured people: every percentage point is money off their side of the ledger. A fault figure offered by an adjuster is a negotiating position, not a finding. Nobody has decided it, and the first number is rarely the last one.

Two things quietly move that percentage in the wrong direction. Giving a recorded statement in the first week, before the medical picture is clear, tends to produce answers that get used later. And a gap between the crash and the first medical record is the single most reliable argument an insurer has that you were not badly hurt.

What Is a Bakersfield Car Accident Claim Worth?

A claim is not one number, it is a set of them, and the ones people leave out are usually the largest.

  • Medical costs already incurred, including the ambulance, emergency room, imaging and follow-up
  • Future care, where an injury needs surgery or therapy that has not happened yet
  • Lost income, and separately lost earning capacity for work you can no longer do
  • Pain and suffering, valued against the medical record rather than asserted
  • Property damage, and the cost of being without a vehicle in a county this spread out

Head injuries are the ones most often missed, because a normal scan answers the emergency question rather than every question. That is why a brain injury claim so often starts from a record saying nothing was wrong. Where a crash is fatal, California limits who may bring a wrongful death claim and how long they have.

If the vehicle that hit you was a commercial one, the case runs differently, because the carrier holds records that expire on a federal schedule. That makes it a commercial vehicle claim. If you were hit while walking, on a bicycle, or on a motorcycle, the fault rules discussed there apply before these do.

How Long Do I Have to File?

Two years from the date of injury, under Code of Civil Procedure 335.1.

Six months to present a written claim to a public entity, under Government Code 911.2, before any lawsuit is possible. This reaches a city or county vehicle, and a crash caused by the road itself on Highway 99, Interstate 5 or State Route 58, where the defendant is Caltrans.

Injured children. Code of Civil Procedure 352 pauses the ordinary limitation period while an injured person is under 18. The six-month government claim rule is not paused in the same way.

Is the at-fault driver’s policy the only money available?

Usually not, and your own underinsured cover is the one people forget. Using it is not a claim against you.

How Do I Get My Bakersfield Collision Report?

From the Bakersfield Police Department Records Unit at 1601 Truxtun Avenue, weekdays 8 a.m. to 5 p.m. A traffic collision report is a flat $7. The traffic report request line is (661) 326-3883, and reports can also be requested online through a third-party service that charges its own fee on top.

Allow longer than you have been told. The department says traffic reports usually take five to seven business days and some take up to ten, but that injury and fatal collision investigations take several days to weeks. That is the reverse of what most people expect, and it is exactly the period when the other driver’s insurer is calling and asking for a recorded statement while telling you it only needs the report to close things out. You do not have to give one, and you do not have to wait for the report to start protecting the rest of the evidence.

The investigating officers are not at that address. The department’s Traffic Section works out of the Westside Substation at 1301 Buena Vista Road, across the city from the Records counter.

If you reported it online, understand what you have. The department accepts some reports online, including hit and run, and says plainly that an online report is for documentation and insurance purposes only and will not bring an officer to the scene. You have a case number rather than an officer’s measurements, photographs and observations. Everything that would have been in those has to come from elsewhere: intersection and business cameras, witnesses, the vehicles themselves. Camera footage is usually overwritten within days, which is the real reason to move quickly.

Where Will My Case Be Filed, and Where Will I Be Treated?

A car accident claim seeking more than $35,000 is an unlimited civil case, filed at the Metro Justice Building, 1215 Truxtun Avenue and heard in Kern County before a Kern County jury. Limited civil cases up to $35,000 go to the Metropolitan Division and the regional courts around the county.

The most serious injuries in the county are taken to Kern Medical, 1700 Mount Vernon Avenue, a Level II trauma center designated in 2001 and re-verified by the American College of Surgeons Committee on Trauma. Where the ambulance took you determines who holds the imaging, the trauma activation record and the first responder narrative. Those are the records a serious claim is built on, so keep the paperwork from every place you were seen, urgent care included.

What is the minimum insurance a California driver has to carry?

It depends on when their policy was issued or renewed. Under Vehicle Code 16056, policies issued or renewed on or after January 1, 2025 must carry at least $30,000 for one injured person, $60,000 for everyone injured in the crash, and $15,000 for property damage. Policies predating that carry the older $15,000, $30,000 and $5,000 floors. Both are still live, because the statute keys the increase to the policy rather than to the accident.

What happens if their insurance does not cover my bills?

That is common on a minimum policy, and it is not the end. Other policies may respond, including one held by the vehicle’s owner, a commercial policy if the driver was working, and your own uninsured or underinsured motorist cover. Identifying all of them usually changes the recovery more than arguing about fault does.

The adjuster says I was partly at fault. Does that end my claim?

No. California reduces recovery in proportion to fault rather than barring it, so a share of the blame lowers the figure without removing the claim. An adjuster’s percentage is an opening position rather than a finding.

Should I give the other driver’s insurer a recorded statement?

Not before taking advice. A statement given in the first week, before the medical picture is clear, tends to be used later against the value of the claim. That is different from your duty to cooperate with your own insurer, which is a real obligation under your policy.

I am undocumented. Can I bring a claim without putting myself at risk?

Yes, and the protection is stronger than most people expect. Under Evidence Code 351.2, added by AB 2159, evidence of a person’s immigration status is not admissible in a civil action for personal injury or wrongful death, and discovery into it is not permitted either.

Is it better to settle with the insurer or get a lawyer?

That depends on facts you can check rather than on a rule. If nobody was hurt and the only issue is vehicle damage, handling it yourself is often reasonable. Once there is an injury, the questions that decide the figure are ones an adjuster is not going to raise with you: whether the other driver’s policy limits actually cover your treatment, whether there is a second policy, whether your own uninsured or underinsured coverage responds, and whether the injury has finished declaring itself. A first offer made before the treatment is finished is an offer made without the main number in it.

How long do I have to get a lawyer after a car accident in Bakersfield?

The filing deadline is two years for an ordinary claim against another driver, but the practical deadline is much sooner, and where a public entity is involved a written claim is due within six months. The evidence sets the real clock: camera footage is overwritten within days, vehicles are repaired or scrapped, and witnesses become harder to find. There is no advantage in waiting, and the report taking several weeks is not a reason to.
