Who Can Recover for Wrongful Death

California Code of Civil Procedure 377.60 clarifies who can recover for the wrongful death of a loved one. It includes the personal representative of the estate, the surviving spouse or domestic partner of the victim, and children and the issue of any deceased children of the victim. Wrongful Death vs. Survival Action

California Code of Civil Procedure 377.60 states there is a wrongful death cause of action “for the death of a person caused by the wrongful act or neglect of another.” This means family members may bring suit for any loss they experience due to the death of their loved one. As a rule of thumb, if the victim had had a personal injury claim if they had lived, their loved ones have a wrongful death claim. 

There is another cause of action available for the estate of the decedent. It is known as a “survival” cause of action. It can be found in California Code of Civil Procedure 377.30 and differs from wrongful death. A survival suit is brought to recover for losses suffered by the victim, not the victim’s family. It is possible in some situations for both wrongful death and survival claims to be made in conjunction with one another. 

Wrongful Death Statute of Limitations

There is a two-year time limit during which a cause of action for wrongful death must be brought, or the people entitled to bring the suit may be forever barred. The clock starts ticking when the decedent dies, which is why it is imperative to seek legal counsel as soon as possible after the victim’s death.
